Terms of Services (April 2025)

1. Services

Alphaport OG provides server hosting services based on Kubernetes, including monitoring, backups, and SSL certificates. We also develop custom software solutions according to client requirements.

2. Hosting: Availability, Duration & Liability

(1) Our hosting contracts have a minimum term of 12 months. Cancellations must be submitted at least 60 days before the end of the contract term. If not canceled in time, the contract will automatically renew for another year.

(2) We strive for high availability and data security. However, disruptions, outages, or data loss may occur. We cannot guarantee 100% uptime or error-free operation.

(3) Alphaport OG is only liable for damages caused by gross negligence or willful misconduct. We are not liable for indirect damages, loss of profits, or data loss, except where mandatory legal provisions apply.

3. Hosting: Data Security & Backup

Regular backups are performed. Nevertheless, the customer remains responsible for safeguarding critical data.

4. Software Development

(1) The scope of services is defined in the individually agreed project contract. Any changes to the scope must be confirmed in writing.

(2) The client is required to contribute to the project by providing clear requirements and timely feedback.

(3) After completion, the software will be handed over and made available for testing. If the software is not explicitly accepted or no significant defects are reported within 14 days, it shall be deemed accepted.

(4) We are not liable for any consequential damages, loss of profits, or data loss from custom-developed software, except in cases of gross negligence or willful misconduct.

(5) The intellectual property rights for the developed software remain with Alphaport unless explicitly agreed otherwise. The client receives a non-transferable, non-exclusive right to use the software as agreed.

5. Support

We offer technical support via email and/or ticket system during our business hours (weekdays from 9:00 AM to 5:00 PM). Our usual response time is within 48 hours. Emergency support and extended SLAs can be arranged individually.

6. Confidentiality

Both parties agree to treat all confidential information exchanged during the cooperation—especially technical details, trade secrets, and project data—as confidential and not to disclose it to third parties. This obligation remains in effect even after the end of the collaboration.

7. Changes

We reserve the right to modify our services or these terms and conditions at any time. Any changes will be published on our website.

8. Jurisdiction

Austrian law applies. The place of jurisdiction is Grieskirchen, unless otherwise required by law.
